The regulator English football built after the Super League

The Independent Football Regulator is the UK's first statutory regulator of football, created by the Football Governance Act 2025 (Royal Assent 21 July 2025). Its perimeter covers the top five tiers of the English men's game — Premier League down to the National League, roughly 116 clubs. It was a direct policy response to the 2021 European Super League breakaway and to a run of club financial collapses.

Its core instruments are a club licensing system, strengthened owners' and directors' tests, financial-sustainability and heritage protections, and a backstop power to impose a revenue-distribution settlement between the Premier League and EFL if the leagues fail to agree. The backstop is designed as a deterrent the regulator would rather not use.

03 OPERATING REALITY

How the institution actually functions

The central tension is jurisdictional, not operational. FIFA and UEFA statutes ban government interference in football, and UEFA has repeatedly warned against scope creep beyond financial sustainability and heritage. Both bodies have so far indicated the regulator as constituted does not breach their rules — but that tolerance is conditional on the IFR staying narrow, and a future Secretary of State retains powers that could widen its remit.

The regulated entity is openly sceptical of its regulator: the Premier League lobbied Parliament warning the regime risked triggering FIFA/UEFA sanctions. That adversarial launch posture is unusual, and it raises the stakes on the backstop. The IFR's credibility now rests on whether it can force a PL/EFL deal it would prefer the leagues to reach themselves.

04 STRATEGIC POSTURE

Direction in 2026

The near-term programme is the licensing regime and a first State of the Game review, expected to inform the distribution question and examine parachute payments. The decisive test is whether the threat of the backstop alone produces a voluntary PL/EFL settlement in the 2026–27 cycle, or whether the regulator has to impose one — the first real exercise of its statutory teeth.
